The age criterion&lt;br /&gt;may be suitably relaxed in exceptional cases for reasons clearly stated in the Home Study Report. However, in no case should the age of the prospective adoptive parent(s) exceed 55 years.&lt;br /&gt;&lt;br /&gt;2. In case of special needs children with medical problems, the age limit of adoptive parent(s)&lt;br /&gt;may be relaxed by concerned state government.&lt;br /&gt;&lt;br /&gt;3. The prospective parent(s) should have a regular source of income with a minimum average&lt;br /&gt;monthly income of at least Rs.3000/- per month. First, the prospective adoptive parents (PAPs) should register with the local licensed adoption agency or adoption coordinating agency and their interest in adoption is ascertained at this stage.&lt;br /&gt;&lt;br /&gt;2. A home study of the PAPs is conducted by the social worker of the agency. To ease the fears and apprehensions of PAPs, pre-adoptive counseling sessions are undertaken by the social worker. For the social worker, assessing the ability of the couple to parent a child not born to them is of crucial importance. Therefore, the couple’s suitability to care for an unrelated child is ensured through this home study.&lt;br /&gt;&lt;br /&gt;3. After the initial survey, PAPs should submit documents related to their financial and health status to the agency.&lt;br /&gt;&lt;br /&gt;4. A child is then shown to the parents. If desired by the parents, the agency takes care to match a child meeting the desired description.&lt;br /&gt;&lt;br /&gt;5. The agency files a petition for obtaining the necessary orders under relevant act once a successful matching has been done. In some cases, the child may also be placed in pre-adoption foster care with adoptive parents.&lt;br /&gt;&lt;br /&gt;6. Fees, as prescribed by the government, will be charged by the licensed adoption agency for maintenance and legal cost.&lt;br /&gt;&lt;br /&gt;The above process is normally completed in 6-8 weeks once the child has been matched with the parents. Shenoy, Chair, &lt;br /&gt;International Relations Committee, &lt;br /&gt;Indian Council of Social Welfare, Mumbai&lt;br /&gt;&lt;/b&gt;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;1st International Conference on Inter- country Adoption organized by Child NGO Federation- Nepal at Katmandu, Nepal on 10th, 11th and 12th March 2007&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Introduction&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;The Government of India is fully sensitized and committed to the rights and welfare of children. The Constitution of India under Article 24- Chapter on “Fundamental Rights of the Citizens” provides the right against exploitation of the children below 14 years. Article 45 of the Directive Principles of the State Policy in the Indian Constitution envisages for free and compulsory education of children.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Basic Indian Policy&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;At the International level, India has ratified the convention on the Rights of Child and the Hague Convention on inter- country adoption of children. At national level, India has prepared a National Policy for children in 1974 under which Ministry of Social Justice and Empowerment (now known as Ministry of Women and Child Development) has got the mandate to enact laws regarding welfare of children. The Juvenile Justice (Care and Protection of Children) Act 2000 is a landmark in this regard. This Act has incorporated the provision of adoption of child as an alternative to institutional care.&lt;br /&gt;&lt;br /&gt;Adoption provides a very important function in Indian society. India has long tradition of child adoption. In olden days, it was restricted within the family and was covered by social and religious practices. But with the changing times, adoption beyond the contour of family has been institutionalized and legalized.&lt;br /&gt;&lt;br /&gt;What Government of India and State Governments is providing necessary support and guidance through its policies and programmes, the Non- Governmental Organizations (NGO’s) provide necessary delivery system for the process of adoption which is above board and transparent.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Implementation of Policy -- Central Agency&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;To strengthen adoption rules and facilitate adoption without any hassles, Government of India under advice of Supreme Court constituted a Central Agency- Central Adoption Resource Agency [CARA] with New Delhi as base to set up guidelines for adoption time to time safeguarding welfare and rights of children while granting adoption or guardianship under Hindu Adoption and Maintenance Act 1956, Guardians and Wards Act 1890 or Juvenile Justice Act of 2000. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Scrutiny Agency&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;To safeguard malpractices and deviations from prescribed guidelines for adoption notified by Government of India, Supreme Court of India has appointed an independent NGO with experience in child adoption – “The Indian Council of Social Welfare” with head quarters in Mumbai and branches in all state as Scrutiny Agency. This agency verifies all the relevant documents and authenticity before orders are issued by Judicial Courts for the formal adoption..&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Guidelines for adoption&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;CARA has issued separate policy guidelines for inter- country and in- country adoptions. The main policy adopted is placement agencies involved in adoption should strictly follow and comply with the guidelines of CARA and register with respective state governments. No Objection Certificate [NOC] from CARA is made mandatory in case of all inter- country adoption, before placement agency process the application in competent Judicial Courts.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Agencies approved for adoption&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;For safe guarding interest and welfare of child, India Government has recognized following agencies. &lt;br /&gt;1. Indian Placement Agencies   - 73   (in various states)&lt;br /&gt;2. Foreign Placement Agencies Enlisted - 254 (in foreign countries)&lt;br /&gt;3. Voluntary Co- ordinating Agency in India - 13   (in various states)&lt;br /&gt;4. Scrutiny Agencies    - 13   (in various states)&lt;br /&gt;&lt;br /&gt;More than 2000 children are given for adoption within India while above 1100 children are sent outside India for adoption.&lt;br /&gt;&lt;br /&gt;Year   In- country   Inter- country&lt;br /&gt;2003   2150    1384&lt;br /&gt;2004   2350    1310&lt;br /&gt;2005   2454    1266&lt;br /&gt;&lt;br /&gt;Implementation of Hague Convention Recommendations&lt;br /&gt;&lt;br /&gt;India Government has notified various adoption policies consistent with Hague Convention as shown below.&lt;br /&gt;&lt;br /&gt; Central Authority (Art.6)&lt;br /&gt;• Central Adoption Recourse Agency (CARA)&lt;br /&gt;• Setup as a Wing of the Ministry of Welfare on 28.06.1990&lt;br /&gt;• Made an autonomous body on 18.03.1999 &lt;br /&gt;&lt;br /&gt;&lt;br /&gt; Child is declared adoptable (legally Free for Adoption) by the concerned public authority, such as, Child Welfare Committee, etc. (as required under art. 4.a.)&lt;br /&gt; Priority is given to in-country adoption before a child is proposed for inter country adoption through the VCA’s &amp; State Governments concerned (as required under art. 4.b. &amp; 16.b.)&lt;br /&gt; All authorities/agencies including CARA apply the principle of ‘Best Interest of the Child’ to an adoption case (as required under art. 4.b. &amp; 16.d.)&lt;br /&gt; Necessary consents of biological parents, adoptive parents and the older Childs are obtained before an adoption is effected. (As required under art. 4.b. &amp; 16.d.)&lt;br /&gt; Adoption is permitted only through recognized placement Agencies with professionally trained Social Workers. (as required under art. 11)&lt;br /&gt; Adoptive parents are required to escort a child from India for the secured transfer of the child as required under 19.2&lt;br /&gt; Any improper financial or other gain is prevented (as required under art. 8 &amp; 32) through:&lt;br /&gt;• Fixing adoption costs.&lt;br /&gt;• Prohibition of direct contact between Prospective Foreign adoptive parents and Indian Agencies.&lt;br /&gt;• Prohibition of middlemen.&lt;br /&gt;• Giving recognition to those Indian Agencies for working under the Convention who work with non-profit motive.&lt;br /&gt;• Financial Returns furnished by the inter-country adoption Agencies to charity commissioners, local state government &amp; Ministries. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Procedure followed for inter country adoption are&lt;/b&gt;:&lt;br /&gt;&lt;br /&gt;I. Child is made legally free for adoption&lt;br /&gt;• By relinquishment deed from biological parents&lt;br /&gt;• No legal claim certificate from child welfare committee formed by &lt;br /&gt;state after making legal enquiry  &lt;br /&gt;&lt;br /&gt;&lt;b&gt;II. Adoption Agencies&lt;/b&gt; &lt;br /&gt;&lt;br /&gt; &lt;b&gt;Step I&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;For adoptive parents: &lt;br /&gt;&lt;br /&gt;Pre- adoption counseling&lt;br /&gt;&lt;br /&gt;Application and Registration&lt;br /&gt;&lt;br /&gt;Home study report- Identifying the child needs. &lt;br /&gt;&lt;br /&gt;&lt;b&gt;Step II&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Identifying a child to meet the needs of adoptive parents.&lt;br /&gt;&lt;br /&gt;Making arrangement to see the child by adoptive parents.&lt;br /&gt;&lt;br /&gt;Take the child for medical check up.&lt;br /&gt;&lt;br /&gt;File documents to court for adoption order.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt; &lt;b&gt;STEP III .Voluntary Co- ordinating Agency &lt;/b&gt;&lt;br /&gt;(now known as Adoption Co- ordinating Agency)&lt;br /&gt;&lt;br /&gt;• Registration of adoptive parents &lt;br /&gt;• Registration of child available for adoption&lt;br /&gt;• Home study reports (by foreign enlisted Agency for VCA)&lt;br /&gt;• Furnishing data to CARA to create a data a bank &lt;br /&gt;&lt;br /&gt;&lt;b&gt; STEP IV. CARA- Central Adoption Recourse Agency&lt;/b&gt; &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;• To issue NOC to agencies to match child with foreign adoptive couple. &lt;br /&gt;&lt;br /&gt;&lt;b&gt; STEP V. Scrutiny Agency&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;• Verifying documents and child and give its recommendation to judicial courts.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;STEP VI.  Judicial courts&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;• Court examines the documents filed by placement agency, Adoptive parents and Scrutiny agency and satisfies itself everything is in order before issuing order for guardianship. A double check is made by the court about composite age, attitude and income of the adoptive couples. &lt;br /&gt;&lt;br /&gt;• When orders are issued child is free to be taken outside country for adoption.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Conclusion&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;To conclude the trust of national policy of India for welfare of children is:&lt;br /&gt;To protect abandoned and destitute children, goal is to find a family for as many orphan children as possible and to safeguard their interest as visualized in the UN Convention on child rights and Hague Convention on Inter country adoption ratified by India government. The ‘Best Interest of the Child’ is the guiding principle behind all adoption laws in India and social awareness programmes has helped to change the attitude of society and people towards adoption in India. &lt;br /&gt;&lt;br /&gt;The nation’s children are supreme important asset. Their nurture and solitude are responsibilities of nation. Children’s programmes should find a prominent part in national plans for the development of human resources so that children grow up to become robust citizens; physically fit, mentally alert and morally healthy endowed with the skills and motivation needed by the society. Adoption might be a good option for them. Adoption can be one of the most rewarding experiences of your life  and you can choose to do it for non-medical reasons also. &lt;br /&gt;&lt;br /&gt;Choosing to adopt a child means you are willing to make a lifelong commitment to raising a child and creating a family for that child.Before you adopt Ensure that both the parents are keen to adopt. The process is long and arduous and can get frustrating at times.If all goes well, the prospective parents file a petition for adoption. Hindus adopt a child under the Hindu Adoptions and Maintenance Act of 1956). Whereas all other religions must file a petition under the Guardians and Wards Act of 1890. If the child is above 6, the the consent of the child is also required. The adopted child Should not be more than 12 years.&lt;br /&gt;&lt;br /&gt;Who can adopt a child ?&lt;br /&gt;&lt;br /&gt;Married couples can adopt. Even single people can adopt. The process and the paperwork might be different. There is some confusion about whether single males can adopt. According to CARA (Central Adoption Resource Authority), even single males can adopt and anyone disallowing single males to adopt are violating their fundamental rights. But, some agencies might not be following this.&lt;br /&gt;&lt;br /&gt;Indians, NRIs and even non-citizens can adopt an Indian baby. Different documentation is needed for the different categories.Both parents need to be at least 21 years of age. The combined age of the parents cannot exceed 90 and the age of either parent cannot exceed 55. In case of older and special needs children, the upper age limit can be relaxed, based on the merits of the case.The agency will ensure that the prospective parents are financially and mentally stable.&lt;br /&gt;The adoption agency matters Make sure you opt for a licensed adoption agency. You can visit the agencies to short list and interview the staff there. Get names of agencies from friends and the Parentree community.Another good resource for information is CARA (Central Adoption Resources Authority)&lt;br /&gt;&lt;br /&gt;Adoption process in a nut-shell&lt;br /&gt;The agency conducts interviews over multiple sessions. The interviews are held with all the family members present as well as separately with each family member. This helps the social worker to assess the family interaction.Contrary to popular belief, the couple doesn't get to choose a child. Based on the interviews, the agency narrows down on the most suitable child for the parents.The identity of the child's biological parents is kept confidential according to the law.But the adoptive parents will be provided with the birth history, social background and medical profile of the child. If the parents feel that that the child is not meet their expectations, they can refuse but too many refusals can annoy an agency.&lt;br /&gt;The first time the prospective parents and the child meet under the social worker's supervision. At this stage, the parents are shown the child's medical certificates. Parents can also take the child to their preferred doctor for a complete medical check-up (with the social worker's presence).Once the parents make a final decision, they will need a lawyer to file the relevant papers in court.Do not forget to get a copy of the birth certificate of the child.The process can take at least 6 months to a year.Once you adopt...Once the child comes to the new family, there is anxiety on both sides. The child may show some nervousness and insecure behavior like excessive crying or being clingy. The kid will need extra assurance and care at this time.&lt;br /&gt;The adoption agency is required to conduct follow-up sessions with the family for adoptions in India.Time with your baby Once you adopt, it is very important that both parents spend a lot of time bonding with the child. If you are working, take child-adoption leave once the child arrives.  Central government employees get child-adoption leave for 135 days along the lines of maternity leave. Many states are in the process of passing this law for state government employees. Meanwhile, many private sector companies, especially IT companies are sensitive to the needs of their employees and are already offering this leave to them. So, do ask if your company has this leave and if not, you could try and influence them to institute this child-adoption leave.Be prepared Adoption is a complex emotional process also. Make sure you are ready to work through it. A time may come when you have to think about whether to tell the child she is adopted or not. A time may come when your child may want to seek out his biological parents to discover who they were.
